ISLAMABAD: The Supreme Court of Pakistan has accepted the petition for hearing challenging abolition of West Pakistan restriction marriage with foreign nationals rules, 1963 on Tuesday (today).
Three-member bench of apex court comprising Chief Justice Tassaduq Hussain Jillani, Justice Khilji Arif Hussain and Justice Sheikh Azmat Saeed heard the petition moved by Zulifqar Bhutta advocate on Monday.
The court has clubbed the petition with case regarding the rights of minorities and adjourned the further hearing for one week.
Zulifqar Bhutta advocate arguing the case said that the restriction marriage with foreign nationals’ rules 1963 are clear violation of basic Islamic teachings as well as the constitution of the country, adding that Registrar of this court has returned the petition with objections that SC is not proper forum. He requested the court to accept the petition for hearing.
The court observed that the petitioner’s appeal against objections of registrar is time bard; however the court accepted the main petition for hearing.
It is worth mentioning here that the petitioner making party to Federation through Secretary Law and Justice as well as Secretary Establishment in the case had prayed that court may nullify the restriction marriage with foreign nationals’ rules, 1963, adding that these rules are the clear violation of basic Islamic teachings as well as the constitution of the country.
The citizens have been deprived from the right of marriage on free will through “restriction marriage with foreign nationals’ rules, 1963” petition says.
Earlier the registrar of the court had raised the objections on the petition stating that SC is not the proper forum for hearing of this petition but petitioner moved appeal against the objections. The court had decided the appeal prior to start hearing of the main case. Further hearing of the main petition has been adjourned for one week.
