ISLAMABAD: The Supreme Court (SC) of Pakistan on Wednesday has rejected the reply of Khyber Pakhtoonkhwa (KPK) government terming it dissatisfactory after reviewing the report presented by Advocate General KPK Latif Yousufzai on behalf of provincial chief secretary.
The Pakistani federal government also presented the notification of Protection of Pakistan Ordinance (PPO) in the Supreme Court of Pakistan during the hearing case pertaining to 35 missing persons of Malakand agency, while court has rejected the reply of Khyber Pakhtoonkhwa (KPK) government terming it as dissatisfactory.
Three-member bench of apex court comprising Justice Jawwad S Khawaja, Justice Iqbal Hameedur Rehman and Justice Mushir Alam heard the case here on Wednesday.
Newly appointed Attorney General Salman Aslam Butt presented the notification before the court and contended that the ordinance has been prepared over a night.
Justice Jawwad S Khawaja observed that the draft of this ordinance has been presented in apex court in July 2013, whether the night was that much long, adding that court would examine the ordinance.
Meanwhile Advocate General KPK Latif Yousufzai presented the report on behalf of provincial Chief Secretary.
The court after examining the report observed that it is not a proper reply that KPK government has said that federation can take any action in the province, adding that how it is possible that provincial government deny from his duties. Provincial government should find its citizens and should know that where are present their citizens.
If the government is not interested, we can summon Chief Minister KPK Pervez Khattak.
Responding to the court quarries Advocate General KPK Latif Yousufzai assured the court that KPK government would file proper reply on next date of hearing.
Earlier as court started the hearing of case Attorney General appeared before the court and informed that government to promulgate an ordinance by today, adding that the draft has been finalized.
Justice Jawwad the head of bench stated the same stance of federation had already been presented before the court last year in July but there is the question of credibility.
Justice Jawwad remarked that the current worst situation of law and order is result of non enforcement of the laws.
AG Slaman informed that he personally held meeting with Chief executive, who issued orders for promulgation of the ordinance, adding that he would present the notification within two hours.
In this contention of AG court adjourned the hearing case for some time. Later court resumed the hearing and AG presented the notification and said that federation has made three amendments in ordinance. The court observed that it would examine the Ordinance.
Later the court giving time to KPK advocate general Latif Yousaf zai for filing the detailed report adjourned the hearing till January 27.
