Islamabad: The Supreme Court of Pakistan has said that civil servants are not bound to obey their officers’ orders that are unlawful and against the interest of citizens of the country.
The apex court expressed these views while giving its verdict on a petition filed in context with due protection to civil servants.
While hearing the case, the three-member bench led by Chief Justice of PakistanIftikhar Muhammad Chaudhry remarked that measures taken under the directions of senior officers and dictators could not be legalized. The CJ said that the appointments, promotions, and sacking should be done purely on merit and according to law.
The SC stressed that the entire process should be done with honesty and good will. It also said that any state officer deliberately defying the court orders was liable to the contempt of court proceedings.
