Islamabad: A three-member bench of the Supreme Court of Pakistan headed by Chief Justice Iftikhar Muhammad Chaudhry resumed the hearing of suo motu notice pertaining to the formation of an inquiry commission over NAB Chairman Admiral (retd) Fasih Bokhari‘s letter to the country’s president.
In the letter sent Jan 27, Admiral (retd) Bokhari accused the court of interfering in NAB investigations, particularly against politicians, and endangering the independence of their work.
During the proceeding, the CJ remarked that the Law Ministry had attempted to deteriorate the situation in the country by forming a two-judge commission over the Supreme Court.
The chief justice further said that the apex court was being dealt with as if the judiciary was a subordinate of the administration.
The ministry informed the bench that the commission was formed when the prime minister sought advice over the issue. The ministry, however, added that the constitution of the commission had been postponed until the next order.
On this the CJ remarked that the PM had not asked for the formation of the commission, adding that he just sought advice.
The hearing into the case is underway.
