LAHORE: Lahore High Court Chief Justice Umar Ata Bandial on Monday disposed of a case regarding recounting of votes in NA-122 constituency and referred the matter to the Election Commission of Pakistan.
Earlier Election Commission had ordered the inspection of record on application of Imran Khan but Sardar Ayyaz Sadiq had obtained stay order against the decision of ECP from LHC.
The case petitioned by Imran Khan’s Pakistan Tehreek-e-Insaf, seeing recounting of votes in the National Assembly constituency which Khan lost to Pakistan Muslim League-Nawaz (PML-N) candidate Sardar Ayaz Sadiq. Khan blamed the ruling party for rigging in votes.
A bench headed by Chief Justice LHC Umar Ata Bandial heard the case on Monday and referred the matter to ECP.
The CJ observed that PTI has no confidence in Returning Officers who are not authorized to act themselves. “Don’t condemn the judges for they can’t respond,” he observed.
PTI counsel said the party had never disrespected the ROs. Upon this chief justice said the counsel of PTI chief knows very well what he is saying.
Chief justice said if the election commission to conduct checking of the record from any judicial officer then the commission should send formal request to high court. Chief justice said that the judicial officers are busy after performing the election duties and are unable to perform such duty time and again.
Chief Justice Umar Ata Badial said that the judiciary had decided to handover the services of the judicial officers for the election on the request of all political parties.
