Supreme Court Restores Pervez Musharraf’s Death Sentence

Islamabad: The Supreme Court has restored the death sentence of former President Gen (retd) Pervez Musharraf.

According to news agencies, the appeal against the death sentence of former President General (Retd.) Pervez Musharraf was heard by a 4-member bench of the Supreme Court, headed by Chief Justice Justice Faiz Essa. Besides the Chief Justice, the Larger Bench included Justice Mansoor Ali Shah, Justice Aminuddin Khan, and Justice Athar Minallah.

During the hearing, lawyer Hamid Khan who represented Asif, presented his arguments. Following that, the court asked Pervez Musharraf’s lawyer Salman Safdar to present his arguments.

Salman Safdar, Musharraf’s lawyer, informed the court that there were no instructions from Musharraf’s family. The family is aware of the case, having been contacted more than 10 times since November, however, no instructions, either for or against the case, have been given by the family. “I am not representing Musharraf’s family”, he said.

Later, after hearing the arguments, the court upheld the decision of the special court that had initially awarded the death penalty on December 17, 2019, under Article 6 of the Constitution.

The court stated that despite multiple attempts, contact could not be established with Musharraf’s legal heirs. The court issued notices to his national and international residential addresses to inform Musharraf’s heirs about the court proceedings, and even advertisements in Urdu and English newspapers were published in this regard.

The Supreme Court mentioned in the verdict that two questions were before the court. First, can an appeal be heard after the death of the person? Second, if the death sentence is upheld, are Musharraf’s legal heirs entitled to the privileges awarded to the deceased? The verdict stated that despite numerous attempts, contact could not be established with Musharraf’s heirs. Therefore the verdict stated that the court had no option but to uphold the death sentence.
