In its verdict, the court ordered to register case againstĀ Qamar Zaman Chaudhry, chairman NAB, and Abdul Rauf Chaudhry, Federal Tax Ombudsman (FTO) and chairman of commission for appointments on top positions in government corporations and regulatory authorities.
The apex court declared that both created hurdles in the smooth investigation of one of the biggest financial scams in Pakistan.
The court has also ordered that proceedings be initiated against former commerce minister Makhdoom Amin Faheem, former commerce secretary Salman Ghani and the federal tax ombudsman. The court further issued the ruling which also declared illegal the appointment of Ayaz Khan Niazi as the chairman of NICL.
Chief Justice Iftikhar Muhammad Chaudhry, heading a three-judge bench, said the FIA failed to recover the plundered money. He said the loot was going on incessantly and there was no one to stop the corruption.
Top law ministry officials say that if the apex court passed any adverse remark against any of these two officials or any other officer or held them responsible for anything wrong, they will lose their respective positions. Officials say that the legal course defined in the law will have to be adopted for removing any officer but the federal government will be bound to initiate such a process if the apex court judgment contains any such adverse finding.
The bench observed that in this case the court issued contempt of court against three federal secretaries, including incumbent Chairman NAB Qamar Zaman Ch, Abdul Rauf Ch and Khushnood Lashari. The chief justice said when Zafar Qureshi was the investigating the case, Rs2.5 billion were recovered, but after his transfer no development was made.
