Islamabad: The Supreme Court on Monday rejected an intra-coart appeal of Defence Secretary Asif Yasin Malik regarding disobeying its orders to hold the local bodies (LB) elections in cantonment boards.
A five-member larger bench of the apex court, headed by Justice Nasirul Mulk and comprising Justice Ijaz Ahmed Chaudhry, Justice Athar Saeed, Justice Sheikh Azmat Saeed and Justice Hameedur Rehman, given the order.
The larger bench however halted the trial till November 18 after the attorney general requested for recusal from the instant case as he informed the court that Defence Secretary Asif Yasin Malik filed an affidavit with the apex court on July 2, 2013 after consulting him as well as the Election Commission of Pakistan (ECP) secretary and hence he (Attorney General) could not prosecute the defence secretary in the instant matter.
