Islamabad: Pakistan Attorney General Irfan Qadir on Tuesday told the Supreme Court that President Asif Ali Zardari has decided to file a reference in Islamabad High Court judges appointment case.
A four-member bench of the apex court headed by Justice Khilji Arif resumed the hearing the case.
During the hearing, the AG submitted his written reply before the bench stating the president has decided to file reference in the case under Article 186 of the Constitution.
Justice Asif Saeed Khosa, the member of the bench, remarked that it was a constitutional way that the president should take guidance from a court.
Khosa said that the bench can only advise the president in regard to the reference. However, considering something as unconstitutional and not abiding by it was a dangerous trend, Justice Khosa added.
Akram Sheikh, the counsel of the petitioner Nadeem Ahmed Advocate, objected that unless there was a final decision about the petition, the IHC judges should be given interim authorisation to work.
Later on, the bench adjourned the hearing for two weeks and remarked that the petition would be fixed for hearing against if the president did not filed reference within 14 days.
