Islamabad: The Supreme Court of Pakistan has issued a detailed judgment in Asghar Khan case on Thursday, reiterating that a former head of intelligence and a former army chief were responsible for rigging the 1990 election.
The 151-page verdict said that Ghulam Ishaq Khan, the then President of Pakistan, General (Retd) Aslam Baig and General (Retd) Asad Durrani violated the Constitution and exceeded their powers.
A three-judge bench comprising Chief Justice Iftikhar Mohammad Chaudhry, Justice Jawwad S Khawaja and Justice Khilji Arif Hussain issued the detailed judgment three weeks after it issued a short order on October 19.
It tells about Brigadier Hamid Saeed’s diary which names those who allegedly distributed or took the money.
Earlier, the Federal Investigation Agency (FIA) said they cannot launch an investigation into the accused politicians in the case until a detailed verdict was announced.
Air marshal Asghar Khan filed the case 16 years ago, accusing the Inter-Services Intelligence (ISI) of doling out money to a group of politicians in the 1990s.
The short order issued earlier said that the president, the army chief and the ISI’s director-general were not authorised to constitute an election cell.
It said that the state should implement its authority through the elected representatives of the people.
The election cell “was aided by General (R) Mirza Aslam Baig who was the Chief of Army Staff and by General (R) Asad Durrani, the then Director General ISI and they participated in the unlawful activities of the Election Cell in violation of the responsibilities of the Army and ISI”, the last month ruling said.
