Islamabad: The Supreme Court on Wednesday expressed its annoyance over Advocate General Punjab for presenting recorded of FIR against Pakistan People’s Party (PPP) founder and former Prime Minister Zulfiqar Ali Bhutto.
An 11-judge special bench of the SC head by Chief Justice Iftikhar Muhammad Chaudhry was hearing the presidential reference for revisiting death sentence handed down to Bhutto.
The CJ observed that the reference was neither a petition nor review petition the court was hearing the case as a constitutional obligation.
DIG investigation informed court that record about Bhutto case was being searched.
The CJ ordered that the recorded of FIR be produced before the court till Thursday.
Federation’s lawyer Babar Awan said that trial against Bhutto was conducted in his absentia and was like a military trial.
Justice Khilji Arif Hussain remarked that Buhtto was present in the court on Dec 17, 1977.
Justice Khuwaja asked Babar to explain what the could would have to do after the filing of the reference.
Awan argued things would be cleared gradually.
The CJ asked whether Justice Maulvi Mushtaq, who has been alleged for hourboring bias against Bhutto, was travelling with Zahoor Elahi when firing was opened on his car.
Awan said he didn’t know whether he was present or not, adding if Mushtaq was a courageous person he would have appeared before the court against Bhutto.
