Islamabad: The Supreme Court (SC) on Monday observed that Election Commission (EC) was an incomplete and nonfunctional institution and it was violation of the Constitution.
A three-member bench headed by Chief Justice Iftikhar Muhammad Chaudhry was hearing a petition challenging formation of Election Commission, filed by journalist Mubashir Luqman. The petition states that the government has failed to form ECP according to 18th and 19th amendments to the Constitution.
The CJ observed that what would be value of decisions of the incomplete and nonfunctional institution.
He remarked that the SC had directed in the last hearing that officials be inducted in the EC while the Attorney General (AG) did not submitted government’s reply despite the court orders.
The AG admitted before the court the Election Commission did not exist according to the Constitution. He informed the court that the parliamentary committee of various political parties were discussing the names of the officials to be inducted in the EC. He said that Constitutional obligations would be fulfill soon.
The CJ remarked that if the government wanted run the system it should abide by the law and the Constitution.
