Karachi: Sindh High Court Friday issued notices to intelligences agencies in case pertaining to disappearance of electrical engineering’s student from Karachi.
The notices are issued to Sindh Home Secretary, Director Generals of Military Intelligence, Intelligence Bureau, Pakistan Rangers Sindh, Provincial Police Chief, In-charge Crime Investigation Department, DIG Investigation & Station House Officer of Steel Town police station.
A division bench, comprising Chief Justice Mushir Alam & Justice Syed Hasan Azhar Rizvi, also issued notice to Deputy Attorney General & Advocate General Sindh to file comments within two weeks. Petitioner Naveed Ahmed Qidwai approached court to seek whereabouts of his son Azib Imtiaz Qidwai, missing since April 2, 2011.
He impleaded Sindh Home Secretary, Director Generals of MI, IB, Pakistan Rangers Sindh, Provincial Police Chief, In-charge Crime Investigation Department, DIG Investigation & Station House Officer of Quaidabad police station Karachi, as respondents.
His counsel Muhammad Javaid submitted petitioner’s son Azib Qidwai, student of Electrical Engineering in 8th semester at Usman Institute of Technology of Hamdard University, Karachi. Azib went to mosque to offer morning (Fajar) prayer on April 2, 2011, when unidentified armed persons came there in Dotson vehicle and took him away.
Counsel stated that petitioner lodged report at Steel Town police station, Karachi, vide Roznamcha Entry No. 29 on same day. Since, then he was visiting police station & offices of law enforcement agencies, but whereabouts of detainee were yet to be found.
He alleged that petitioner’s son was unlawfully taken into custody by law enforcement agencies despite fact that he had no affiliation with any political or religious party in violation of Article 9 of constitution.
He prayed to order official respondents to produce detainee & restrain them from falsely implicating him in any case of terrorist. SHC division bench after initial hearing ordered office: “Issue notice to respondents, learned Advocate General Sindh and Deputy Attorney General. To come up after one week.”
