Court accepts govt’s extension plea in Musharraf treason case

ISLAMABAD: Special Court on Tuesday has awarded time to Federal Government till January 7 to implement November 21 court’s order regarding the former president Pervez Musharraf’s treason case.

A two-member bench presided by Justice Tahira Safdar and comprising Justice Yawar Ali Khan heard the treason case of Musharraf in which prosecutor Akram Sheikh said that federation is carefully reviewing the court’s order whereas legal experts have also been consulted.

Justice Tahira inquired that will the action be taken on court’s order in one week? Answering to which, prosecutor stated that “federation knows better about the decision and the time span”.

Justice Tahira further remarked that “you are representing federal government”, on which, Akram Sheikh expressed that the federation will need more than two weeks to decide whether to challenge court’s decision or to accept it.

Moreover, Special Court has adjourned the case hearing till January 8 by accepting the request of federal government to extent the time till January 7.

Earlier, Special Court on partially approved the request for the trial of co-accused in Musharraf treason case and has also ordered to re-record the statements of former prime minister Shaukat Aziz, former law minister Zahid Hamid and Justice Abdul Hameed Dogar.

A three-member bench of Special Court under the presidency of Justice Faisal Arab held a hearing of Musharraf treason case. On approving request to include the names of co-accused in treason case, Special Court has ordered the Federation to submit their reply in next 15 days.

Also, Islamabad High Court issued a notice to Attorney General Salman Butt over the plea against the decision of special court regarding Pervez Musharraf’s treason case. Justice Athar Minallah remarked that the special court has a similar status to that of the high court; therefore, its decision can’t be challenged.

During the hearing of the petition, the petitioner Asif argued that the decision to include in the trial, the co-accused in Musharraf’s treason case should be made void. Musharraf’s trial should be completed soon and the trial of co-accused should be held separately. He said that the decision was violating the legal requirements and would benefit Musharraf.
