Karachi: Sindh High court issued contempt of court notice to Director General (DG) National Logistic Cell (NLC), Maj. General (Retd) Junaid Rehmat, and its legal officer Col. (Retd) Mushtaq Ahmed Khan in compensation recovery suits.
The court while issuing contempt of court notice to DG NLC and its legal officer directed them to submit written replies by Nov 19. The court also ordered Col. (retd) Mushtaq Ahmed Khan to appear in person in the court.
A single member bench of SHC comprising Justice Munib Akhtar had directed the NLC authorities on May 5, 2012 to submit details of major operative accounts and statement of assets of the Cell in 16 miscellaneous compensation suits. Despite the passage of about 6 month after the court’s order the NLC authorities did not submit the details of accounts and assets.
Upon this, an applicant, Gul Muhammad Mir, through his counsel Farrukh Usman Advocate, moved an application in SHC requesting the court to initiate contempt of the court proceedings against the NLC authorities for not complying with the court’s order. The counsel of the petitioner stated that despite the court’s decision and several directions, the NLC authorities did not furnished the details of accounts and assents. He pleaded the court to initiate contempt of court proceeding ageist DG NLC and legal officer of the cell.
The court while accepting the application for hearing, issued show cause notices to DG NLC and legal officer stating that as to why contempt of court proceeding may not be initiated against you.
The court also asked the legal officer NLC to appear in person in the court on next date of hearing.
It is to be mentioned that the SHC had ordered the Cell to pay as compensation amounting about Rs100 million to the decree holders on account of wro.ngful death of several person in fatal accidents involving NLC’s vehicles
