Islamabad: The Judicial Commission on Appointment of Superior Courts Judges on Thursday approved four names for filling the vacancies in the Supreme Court of Pakistan and recommend the names to the Parliamentary Committee for approval.
Those who were recommended for elevation to the apex court are Justice Syed Gulzar and Justice Retd Athar Saeed of Sindh High Court (SHC), Chief Justice Lahore High Court (LHC) Ejaz Ahmed Chaudhry and Chief Justice Peshawar High Court(PHC) Justice Ejaz Afzal.
Sources said that the commission, which met here with Chief Justice of Pakistan Iftikhar Muhammad Chaudhry in the chair, deliberated threadbare over the new appointments in the superior judiciary. Sources said that for filling the four vacancies in the Supreme Court, the commission approved and recommended the names of incumbent chief justices of LHC and PHC, besides a retired and serving judge of the SHC.
They said that after the elevation of LHC and PHC chief justices to the apex court the post of the respective high court top adjudicator were going to fall vacant, hence the commission recommended the name of senior most judge, Justice Shaikh Azmat Saeed for LHC chief justice and Justice Dost Muhammad Khosa of PHC to be appointed as top adjudicator of Khyber Pakhtunkhwa.
The recommendations of the commission would go to the Parliamentary Committee on Judges Appointment, which will approve or reject the names after deliberations. The sources said that the commission also recommended three names for appointment to the Islamabad High Court.
It is to be mentioned here that after the passage of the 18th Constitutional Amendment in 2010, the judicial commission has to recommend names to a parliamentary committee for appointment as judges of the superior courts and the said committee has to refer recommendations to the president for appointment.
The commission is headed by the chief justice of Pakistan and has as its members four senior most judges of the Supreme Court, a former chief justice of the Supreme Court, federal law minister, attorney general for Pakistan, and a senior Supreme Court lawyer named by the Pakistan Bar Council.
However, as for recommendation of judges for appointment to the high court, the said judicial commission will also have the chief justice of the relevant high court, the most senior judge of the high court, the relevant provincial law minister, and an advocate not having less than 15 years practice at the high court to be nominated by the provincial bar council concerned.
