Madrid: Spain announced on Thursday that it will join South Africa’s case at the International Court of Justice (ICJ), accusing Israel of committing genocide in the Gaza Strip. This move comes amid heightened tensions following Israel’s military actions in Gaza, which South Africa claims violate the 1948 UN Genocide Convention.
Foreign Minister Jose Manuel Albares stated at a press conference, that the sole goal is to put an end to the war and to advance on the road of applying the two-state solution. This declaration follows Spain’s recent recognition of the state of Palestine alongside Ireland and Norway, a decision that has provoked strong reactions from Israel.
South Africa initially brought the case to the ICJ last year after Israel’s offensive in Gaza. Israel has firmly denied the genocide allegations and violated the ICJ ruling demanding Israel to halt its military operation in Rafah.
The ICJ, established post-World War II and based in The Hague, adjudicates disputes between states. Recently, it ordered Israel to allow unrestricted access to UN investigators to examine the genocide claims and to prevent acts of genocide during its operations in Gaza. On May 24, the ICJ further directed Israel to cease its military actions in Rafah and to ensure the unhindered flow of humanitarian aid through the key border crossing.
Despite the binding nature of ICJ rulings, enforcement remains a challenge as Israel continues its relentless attacks on Gaza, including Rafah. Israel has also restricted the delivery of aid to the Gaza Strip.
