Islamabad High Court Dismisses Plea Seeking Imran Khan’s Disqualification in Tyrian White Case

Islamabad: The Islamabad High Court (IHC) has rejected a petition seeking the disqualification of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan over allegations of failing to disclose his alleged daughter, Tyrian White, in his 2018 election nomination papers.

A newly constituted bench, consisting of Justice Tariq Mehmood Jahangiri, Justice Arbab Mohammad Tahir, and Justice Saman Rafat Imtiaz, heard the case on Tuesday. This case had been pending since May 2023, following the dissolution of the previous three-member bench by IHC Chief Justice Aamer Farooq.

The previous bench, comprising Chief Justice Aamer Farooq, Justice Mohsin Akhtar Kayani, and Justice Arbab Muhammad Tahir, had reserved their verdict on March 30, 2023. However, the opinions of Justices Kayani and Tahir against the petition’s maintainability were uploaded to the court website but were later removed because they lacked the signatures of Chief Justice Farooq.

During the hearing, the petitioner’s lawyer, Advocate Hamid Ali Shah, acknowledged that the matter had been previously adjudicated. Khan’s lawyer, Naeem Haider Panjhuta, emphasized that the verdict was already issued and subsequently removed from the court’s website, leading to the reconstitution of the bench.

Justice Jahangiri questioned the legitimacy of readdressing a dismissed petition, to which Advocate Shah requested additional time to prepare. However, the court reiterated that the disqualification plea had been previously dismissed, citing the majority decision already issued by the bench.

The petitioner, Mohammad Sajid, had alleged that Imran Khan did not disclose his alleged daughter, Tyrian White, in his nomination papers for the 2018 general elections. Sajid claimed that Khan provided false information to the Election Commission of Pakistan (ECP) by declaring only two children while omitting Tyrian.

The case also referenced a paternity judgment from a superior court in California, which declared Khan as Tyrian’s father. Additionally, it highlighted that Tyrian’s mother, Sita White, had nominated Jemima Goldsmith, Khan’s ex-wife, as Tyrian’s guardian in her will.

With the IHC’s dismissal of the plea, the matter of Imran Khan’s alleged non-disclosure in his nomination papers has been legally resolved for the time being.
