SC 6-Member Larger Bench Hearing Case of Trials of Civilians in Military Courts Dissolved

Islamabad: The 6-member larger bench of the Supreme Court hearing the case related to trials of civilians in military courts dissolved on Monday after Justice Sardar Tariq Masood recused himself from proceedings.

The proceedings initiated on Monday with Justice Masood expressing his intention to address objections against the bench first. The lawyer of Jawad S Khawaja raised objection about the bench’s composition on the and said the matter should be sent to the Judges Committee for reconstitution of the bench. Lahore Bar lawyer Hamid Khan tried to present arguments in the case, on which Justice Sardar Tariq Masood remarked that if we are not even hearing the case, don’t present arguments; objection is being raised that I should recuse myself from the case.

Consequently, Justice Sardar Tariq Masood recused himself from the case and the court referred the matter to the Practice and Procedure Committee for bench reconstitution while affirming the continuation of trials for civilians in military courts. The order to proceed with the trials stands effective, maintaining a course set in December when the apex court conditionally suspended its earlier decision to invalidate military trials for 103 civilians until a final judgment.

The court stated that the Practice and Procedure Committee will decide on the formation of the Larger Bench, the order to continue military courts’ trials of civilians will remain in force.

Other than Justice Sardar Tariq Masood, the bench 6-member bench included Musarrat Hilali Justice, Justice Irfan Saadat, Justice Muhammad Ali Mazhar, Justice Hasan Azhar Rizvi and Justice Aminuddin Khan.

The ongoing military trials relate to individuals accused of involvement in attacks on army installations during unrest following the arrest of former Prime Minister Imran Khan on May 9. The court clarified that the final decision on these trials in military courts hinges on the ultimate ruling.
