Islamabad: In a recent development, the verdict of the Federal Shariat Court against the Transgender Act has been challenged in the Supreme Court of Pakistan.
The Federal Shariat Court, based in Islamabad, issued its verdict on 19th May, asserting that individuals cannot alter their gender based on personal preferences, as it goes against Islamic teachings. The court further emphasized that an individual’s gender should correspond to their assigned gender at birth. The verdict highlighted that individuals cannot identify themselves as Khawajasira (intersex) if their gender diverges from their biological sex.
A petition has been filed in the Supreme Court demanding the reversal of the Federal Shariat Court’s verdict. The petition states that the Federal Shariat Court denied the rights of an entire community, and the Supreme Court should declare the decision of the Federal Shariat Court null and void.
It must be noted that the Federal Shariat Court declared certain provisions related to gender identity and inheritance in the Transgender Act as conflicting with Islamic law.
