Justice Athar Minallah: Courts Should Remain Open Whenever There is a Risk of Martial Law

Islamabad: Supreme Court Justice Athar Minallah defended the decision to keep the courts open on the night of April 9, stating that he wants the courts to remain open whenever there is a risk of martial law.

Speaking at the New York Bar, Justice Minallah said, “On April 9, 2022, a media channel created an atmosphere as if martial law was imminent. I want the courts to remain open whenever there is a risk of martial law.”

He expressed regret that the courts were not open on July 5 when General Zia removed an elected Prime Minister, nor on October 12 when Pervez Musharraf ousted another Prime Minister.

Justice Athar Minallah emphasized that if there had been an attempt to remove Prime Minister Imran Khan, it would have been a test for them and the Islamabad High Court to uphold the constitution’s supremacy.
