Kenya: Court Declares Journalist Arshad Sharif’s Murder Unlawful

Nairobi: The High Court of Kenya has declared the murder of Pakistani anchor and journalist Arshad Sharif as unconstitutional and illegal, ordering the government to pay compensation totaling Rs 21.7 million to Sharif’s family.

The Kenyan High Court, while delivering its verdict on the murder case of Pakistani anchor and journalist Arshad Sharif, termed the killing as unconstitutional and illegal.

Justice Stella Mutuku, delivering the judgment, criticized the use of lethal force against Sharif, who was fatally shot in the head. The court faulted the Attorney General, the Director of Public Prosecutions (DPP), and other investigative agencies for delays in concluding the probe and bringing charges against the responsible police officers.

Upon the request of Arshad Sharif’s widow, the court stated that the police’s mishandling of the case was not due to mistaken identity, and the government agencies mentioned in the petition cannot evade responsibility.

The ruling comes after a two-member fact-finding team appointed by the Pakistani government investigated the incident. The team’s report, submitted to Pakistan’s Supreme Court, suggested that Sharif’s killing was a pre-planned targeted assassination rather than a case of mistaken identity, citing contradictions in the Kenyan authorities’ version of events.

The court has instructed the Kenyan government to take strict punitive action according to the law against police officers and officials involved in firing on the Pakistani journalist. The court has ordered Arshad Sharif’s family to be paid a fine of 21.7 million rupees in compensation.

It is noteworthy that Pakistani journalist Arshad Sharif was murdered in Nairobi, Kenya, on October 23, 2022.
